Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity.)

Withdrawal Policy

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party designated by you who is not the carrier, took possession of the goods, provided that you ordered one or more goods as part of a single order and these are delivered together.

To exercise your right of withdrawal, you must inform us (Waldkauz GmbH und Co. You may use the attached model withdrawal form, but this is not mandatory.

You may also exercise your right of withdrawal online via the appropriately labeled button ("Withdraw Contract" or similar wording) on our website(shop.waldkauz.net) If you use this online function, we will promptly provide you with confirmation of receipt on a durable medium (e.g., by e-mail), including information about the content of the withdrawal declaration as well as the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for the reimbursement that you used for the original transaction, unless expressly agreed otherwise with you. In any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us or to Waldkauz GmbH & Co. KG, Berghäuschensweg 57-59, 41464 Neuss, Germany, without undue delay and in any event no later than 14 days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days has expired.

You will bear the direct costs of returning the goods. You are only liable for any diminished value of the goods if this diminished value results from handling the goods in a way that was not necessary to establish their nature, characteristics, and functioning.

Exclusions and Early Expiration of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

for the supply of goods that are not prefabricated and for whose manufacture an individual choice or determination by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs;
for the supply of goods that are liable to deteriorate or expire rapidly;
for the supply of alcoholic beverages, the price of which was agreed upon at the time of conclusion of the contract, but which can only be delivered after 30 days and whose actual value depends on market fluctuations beyond the trader’s control;
for the supply of newspapers, periodicals, or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts:

for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery;
for the supply of goods which, after delivery, have been inseparably mixed with other items due to their nature;
for the supply of sealed audio or video recordings or computer software if the seal has been removed after delivery.
